The Policies and Legalese
The client is contracting with transNET Media® LLC, a Limited Liability Company, located in Phoenix, AZ, to develop and/or improve a website to be installed on web space arranged for by the client on a web hosting service's computer. The client hereby authorizes transNET Media® LLC to access this account, and authorizes the web hosting service to provide transNET Media® LLC with write permission for the client's website directory, cgi-bin directory, databases and any other directories or programs which need to be accessed for this project.
transNET Media® LLC charges $124 an hour for website design, $80 an hour for non-profit organizations. It has been designing with basic HTML code since
1995 and has designed over 300 websites. They accomplish more in an hour and can complete with some who charge much less per hour. It has been using PHP code since 2001.
Estimates are based on what and how the material is submitted to transNET Media® LLC. Using hard copy,
text must be keyed in and will take more time for development. Since transNET Media® LLC charges by the hour this will increase the client's cost. If the client submits the text on computer media in an easily accessible software program, this keeps client costs down.
Estimates are just that. If the client has a budget, this must be discussed. transNET Media® LLC can comply with the budget with the clients cooperation. This means that if the
client is not happy with the design they must pay for the redoing of it.
transNET Media® LLC bases its design on the input of the client. The more information supplied the better.
If the job takes longer than estimated transNET Media® LLC will bring this to the clients attention when this is evident.
If transNET Media® LLC takes less time than the estimated time, the client is only charged for the time spent.
When an estimate is given, a deposit of up to 50% is required to start the website design, unless otherwise agreed on. Upon completion of the website the balance is due. If payment is not completed within 30 days of completion transNET Media® LLC adds a late fee of 20% of the amount that is owned. If after another 30 days the balance has not been paid transNET Media® LLC reserves the right to take down the site and bill another 20% late fee.
transNET Media® LLC charges $124 an hour for updates, $80 an hour for non-profit organizations. This is done by client request only. transNET Media® LLC charges as little as a quarter of an hour, being $28 for an update requiring this amount of time. Most updates are done within 24 hours unless the update is extensive. transNET Media® LLC will give a date of completion.
If the client wishes to update the site, transNET Media® LLC gives the client lessons at $124 an hour. Starting with a one hour lesson teaching text updates. The lesson is geared to the level of the client.
transNET Media® LLC charges a fee of $124 a month (equivalent to one hour's work) to maintain a site, if you request this
service. This includes checking the stats on the site and presence in search engines. It checks to make sure all links and forms are working on the site. Maintenance and Updates are billed at the end of the month. If payment is not received in 30 days a 20% late fee is added the amount owed.
- Web Hosting
The client understands that a separate contract with a web hosting service is required. The client agrees to select a web hosting service which
allows transNET Media® LLC full access to the website and a cgi-bin directory via FTP. The client further understands that other requirements,
such as the ability to accommodate back-end programming and databases may be necessary.
- Search Engines
transNET Media® LLC designs its sites to be search engine friendly. However, search engines change their indexing parameters periodically, which can effect placement. A good amount of aligned content is important for a high ranking. We rely on a client to supply us with sufficient content to analyse for keywords, descriptions, titles as well as text on the page.
It can take six months to a year for a new domain to be indexed by the search engines and changes on an existing domain can take three months to be found.
- Payment of Fees
Fees to transNET Media® LLC are due and payable on the following schedule: 50% upon signing this contract, balance when the website has been completed. Monthly fees are due 30 days after billing. In case the client has not secured Web space on a web hosting service by the time the website is complete, the website may be delivered to the client on diskette or attached to an e-mail message. All payments will be made in US funds.
transNET Media® LLC reserves the right to hire subcontractors (programmers, writers) for this project to insure proper completion.
- Legal Stuff
transNET Media does not warrant that the functions contained in this website or the Internet website will function on all browsers or platforms
or that the operation of the website will be uninterrupted or error-free. It does, however test on Windows platform with Internet Explorer, Firefox, Netscape, Opera and Chrome.
- Copyrights and Trademarks
The client guarantees to transNET Media® LLC that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to transNET Media® LLC for inclusion in websites are owned by the client, or that the client has permission from the rightful owner to use each of these elements.
- Ownership of Website
Upon final payment of this contract, ownership of the website transfers to the client. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. transNET Media® LLC and its subcontractors retain the right to display graphics and other Web design elements as examples of their work in their portfolios.
- Use of credit cards on a site
We build custom shopping carts but do not allow our customers to take credit cards on their site. We always direct them to a third party like: Paypal or authorize.net. We also do not create databases that store credit card numbers or SSI numbers. This is our way of proptecting our customers. A security certificate is not needed on a site that does not take credit cards but sends them to a third party. However, we do mention to our customers that users feel better with a security certificate. Once the site is built, approved by the owner responsibilites of the site are the owners.
- Initial Payment and Refund Policy
This agreement begins with an initial payment of 50%. This deposit finalizes the agreement and there is no refund. Hours of work are compiled and then billed as stated. A deposit is good for one year. If the work comes to less than the deposit amount the balance can be applied to updates.
- Customer Satisfaction Policy
The design of a website is dependent upon clear and concise input from the client. If the website or a portion thereof deviates from the explicit instructions of the client, transNET Media® LLC redoes the site to comply with those documented instructions. If the website does not deviate from the client's instructions but does not meet the client's expectations, the client pays for redos at our usual hourly rate.
When a project is completed and requires testing, transNET Media emails the owner to test the site. They have three months to do so. If the site is found not to function properly within that time, transNET Media fixes the program without charge. If the problem or error is found after three-months, the client pays for the fix.
In addition, if the site is accessed by someone other than transNET Media LLC, and a problem occurs,
even within the 3 months after launching, transNET Media LLC is not responsible.
